About The Games
Tarkin Studios is the owner of The Games. The Games can be provided via the App Store and Google Play. When you install and play The Games through your purchase, Tarkin grants you a personal, limited, non-exclusive, non- transferable, non-commercial license to install and use The Games. Your right to use The Games is limited to the license grant above, and you have no permission to copy, distribute, publish or modify The Game.

When you access and play The Games you shall comply with scoring rules and controls, which are available within The Games, itself and you agree they are part of these Terms and Conditions. You are responsible for the Internet connection and/or mobile charges that you may incur for playing The Games. You may allow The Games to interact with any social network or platform in order to share The Games experience with your contacts in these social networks or platforms. We have the right to modify The Games occasionally or even withdraw it without being liable to you for technical, business or legal reasons or simply to improve The Games itself. The Games may also be unavailable on a temporal basis for technical or maintenance reasons.

Accounts
You agree that you shall take all steps necessary to protect your login details for any social network or platform that you may allow The Games to interact with. We will not be responsible to you for any loss (including any unauthorized purchases) that you suffer as a result of an unauthorized person accessing your account and playing The Games and we accept no responsibility for any losses or harm resulting from its unauthorized use, whether fraudulently or otherwise. We reserve the right to suspend or terminate your access to The Games (including by deleting your account) if we reasonably believe that you are in material breach of these terms (including by repeated minor breaches). Without limitation, any breaches on the "Use of The Games" clause below are likely to be considered material breaches. Purchases
The Games may include items or services for use with The Games ("Virtual Items"). If you are over 18 years old you may be able to buy Virtual Items for real money. Virtual Items can never be exchanged for real money, real goods or real services from us or anyone else. You also agree that you will only obtain Virtual Items from us, and not from any third party.

Tarkin may manage, modify or eliminate Virtual Items at any time, with or without notice. Tarkin shall have no liability in the event that Tarkin exercises any such rights.

Payments
You agree to pay all fees and applicable taxes incurred by you or anyone using your Account. Virtual Items are paid services. Payments for this Virtual Items will always be conducted by our partners Apple Store and Google Play. If you contract these Virtual Items you may have to accept the terms and conditions and privacy policy proposed by this partner’s billing service provider, including its pricing policy and payment system. Tarkin may revise the pricing for the Virtual Items at any time.

You agree that all your purchases of Virtual Items are final and that we will not refund any transaction once it has been made. We reserve the right to control, regulate, change or remove any Virtual Items without any liability to you. If by any reason, we suspend or terminate your account you will lose any Virtual Items that you may have and we will not compensate you for this loss or make any refund to you.

Use Of The Games
The use that you make of The Games is subject to the previous acceptance, on your part, of the present legal Agreement. You agree that you will not:

• Use The Games to harm anyone or to cause offence to or harass any person;


• Create more than one account per platform and Game;


• Use another person or entity’s email address in order to sign up to play The Games;


• Use The Games for fraudulent or abusive purposes;


• Use The Games for any commercial or business purpose or for the bene`it of any third party or to send unsolicited communications;


• Remove or amend any proprietary notices or other ownership information from The Games;


• Interfere with or disrupt The Games or servers or networks that provide The Games;


• Attempt to decompile, reverse engineer, disassemble or hack any of The Games, or to defeat or overcome any of our encryption technologies or security measures or data transmitted, processed or stored by us;


• 'Harvest', 'scrape' or collect any information about or regarding other people that play The Games, including, but not limited to any personal data or information;


• Sell, transfer or try to sell or transfer an account with us or any part of an account including any Virtual Items;


• Disrupt the normal `low of a Game or otherwise act in a manner that is likely to negatively affect other players' ability to compete fairly when playing The Games or engaging in real time exchanges;


• Disobey any requirements or regulations of networks connected to The Games; • Use The Games in violation of any applicable law or regulation;


• Use The Games to cheat or design or assist in cheating (for example, by using automated means or third party software to play), or to otherwise circumvent technological measures designed to control access to, or elements of The Games, or to do anything else that a reasonable person is likely to believe is not within the spirit of fair play or these terms;


• Use The Games in any other way not permitted by these terms.

Territory And General Compliance Of The Legislation
The Service is controlled and exploited by Tarkin Studios from its of`ices in Madrid, Spain. You are obliged to comply with the laws, regulations, decrees, and local and national rules that are applied to the use that you make of The Game in the location that you access The Games from. If any laws applicable to you restrict or prohibit you from playing The Games, you must comply with those legal restrictions or, if applicable, stop accessing and/or playing The Game.

No Warranties
Limitation of Liability. Tarkin Studios will provide The Games with a reasonable degree of professionalism and diligence. Tarkin Studios makes no other warranties about The Games and in particular does not warrant that your use of The Games will be uninterrupted or error free. You agree that Tarkin Studios may occasionally interrupt the service for indefinite periods of time or cancel the service at any time for technical or operational reasons or the lack of availability of our website, Games, and/or social media channels where these are not within our reasonable control. The Games will be free from loss, corruption, attacks, viruses, interference, acts of hacking or other interference in security, which constitute force majeure, and Tarkin Studios disclaims any liability with regard to them.

Intellectual Property
Recognition of Property. You accept that The Games, including but not limited to the Products, software, technology, text, forum posts, chat posts, profiles, widgets, messages, links, emails, music, sound, graphics, pictures, video, code, and all audiovisual or other material utilized to implement The Games, as well as the design and appearance of our websites, contains information and material of private character that are property of Tarkin Studios, its affiliates, subsidiaries, licensees and/or licensors or suppliers, and are protected by intellectual property laws and by other legislation, including but not limited to copyright laws, and you commit to not using the aforementioned information or materials of private nature in any way, except in relation to your use of The Games in accordance with the terms of the present Agreement. No part of the Service may be reproduced in any way, except as specifically permitted in the present document. You engage not to modify, lease, rent, loan, sell, distribute or create derived works from the Service in any unauthorized manner.

Copyright. All copyrights relating to the applications and contents displayed on The Games are the property of Tarkin Studios and/or its affiliates, subsidiaries, licensees and/or licensors or suppliers, who reserve all rights they may have in law or equity. Tarkin Studios has the appropriate licenses on the applications and contents distributed. The use of any part of the service otherwise than permitted by these terms and conditions, is strictly prohibited, will constitute a violation of intellectual property rights of third parties and is punishable by civil and criminal penalties, including payment of compensation for damages resulting from copyright infringement.

All trademarks and graphic content of The Games and other trademarks, service brands, graphics and logos used in connection with the Service are trademarks or registered trademarks of Tarkin Studios or its af`iliates, subsidiaries, licensees and/or licensors or suppliers. All other trademarks, service brands graphics and logos used in connection with The Games may be the trademarks of their respective owners. You are granted no rights or licenses with regards to any of the aforesaid trademarks and their use.

Whilst you are in compliance with these terms, we grant you a non-exclusive, non-transferable, personal, revocable limited license to access and use The Games (but not the related object and source code) for your own personal private use, in each case provided that such use is in accordance with these terms. You agree not to use The Games for anything else.

Third Parties Websites
We may link to third party websites or services from The Games. You understand that we make no promises regarding any content, Items or services provided by such third parties and we do not endorse the same. We are also not responsible to you in relation to any losses or harm caused by such third parties. Any charges you incur in relation to those third parties are your responsibility. Entire Agreement
This Terms & Conditions constitutes the entire agreement between you and Tarkin Studios and governs your use of The Games, superseding any prior agreements between you and Tarkin Studios regarding accessing to and playing The Game. If any provision of this Agreement is held invalid by a competent court, other provisions shall remain in force in all its aspects. Tarkin Studios is not responsible for any failure to comply with any of its obligations due to causes beyond its control.

Assigment
Tarkin Studios reserves the right to assign or transfer to others its rights and obligations under this Agreement in part or in total, without needing your previous consent.
